Can a California Notary Public notarize a Power of Attorney?
Yes. A California Notary Public can notarize a Power of Attorney as long as the signer personally appears, is willing, appears aware, and presents acceptable identification as required by California law.
Does a Power of Attorney need to be notarized in California?
Many Powers of Attorney are notarized in California, especially when they will be used for financial, legal, real estate, healthcare, or international matters. Some receiving agencies also require notarization before they will accept the document.
What identification is required to notarize a Power of Attorney?
The signer must present acceptable identification under California law, such as a current California driver's license, state-issued identification card, or U.S. passport. If acceptable identification is unavailable, credible witnesses may be used if permitted under California law.
Can a California Notary Public provide a Power of Attorney form?
No. A California Notary Public cannot prepare legal documents, recommend legal forms, or provide legal advice. Clients should bring a completed Power of Attorney or obtain one from an attorney or trusted document provider.
Should I sign my Power of Attorney before the appointment?
No. Unless you have been instructed otherwise by the document preparer or receiving agency, wait until the appointment. Many documents requiring notarization should be signed or acknowledged in the presence of the notary after your identity has been verified.
Can a Power of Attorney be notarized at a hospital, care facility, or home?
Yes. I provide mobile notary services at homes, hospitals, assisted living communities, rehabilitation centers, skilled nursing facilities, hospice facilities, and other convenient locations throughout San Mateo County and Santa Clara County. The signer must be willing, aware, able to communicate directly with me, and capable of understanding the document being notarized.
Does a Power of Attorney require witnesses in California?
Witness requirements depend on the type of Power of Attorney and how it will be used. Some financial institutions, healthcare providers, attorneys, or receiving countries may require witnesses in addition to notarization. It is important to confirm any witness requirements before your appointment.
Can a notarized Power of Attorney be apostilled for another country?
Yes. In many cases, a properly notarized California Power of Attorney can be submitted to the California Secretary of State for an apostille if it will be used in a country that is a member of the Hague Apostille Convention. If the destination country is not a Hague Convention member, additional authentication or embassy legalization may be required.
How much does it cost to notarize a Power of Attorney?
California law allows a maximum fee of $15 per notarized signature. Mobile service also includes a travel fee based on your location, appointment time, and travel distance. If your Power of Attorney will also require an apostille for international use, California Secretary of State fees and apostille processing fees will apply.
