Document Requirements for Apostille Submission
To qualify for California apostille processing, corporate documents must be either:
✔ Original certified copies issued by the California Secretary of State or County Clerk
OR
✔ Properly notarized copies of the document
For notarized copies, the notarial act must:
Be performed in California
Clearly identify the signer
Include proper notarial wording
Not contain blanks or alterations
If your document is not yet notarized, I provide mobile notarization throughout San Mateo County and Santa Clara County.
Common Corporate Documents That May Require an Apostille
Authenticated vs. Notarized Corporate Documents
Different corporate documents are handled differently:
Secretary of State–Issued Documents
(Ex: Certificate of Status, Articles of Incorporation)
✔ Usually submitted directly for apostille
✔ No notarization required
Privately Executed Corporate Documents
(Ex: Resolutions, bylaws, minutes)
✔ Must be notarized before apostille submission
Clients should confirm with the receiving authority which type applies to their situation.
Apostille vs. Embassy Legalization
International processing may follow one of two pathways:
-
Apostille — for countries in the Hague Apostille Convention
-
Authentication + Legalization — for non-Hague countries
How the Corporate Apostille Process Works
-
The client determines what documents are required by the receiving country or organization.
-
I review the documents for California apostille submission eligibility (or notarization requirements if applicable).
-
Submission is made to the California Secretary of State for apostille processing.
-
If the receiving country does not accept apostilles, the client may need additional steps such as:
-
U.S. Department of State authentication
-
Embassy or consulate legalization
-
-
Completed documents are returned with tracking.
Note: I facilitate the California apostille step. Acceptance and legal effect abroad are determined by the receiving authority, not the apostille agency.
Processing Timelines
Typical timelines are:
-
California apostille processing: typically ranges from 1 to 10 business days, depending on the level of service selected and current processing conditions.
-
Additional federal or consular steps (if required) may extend overall timelines.
