How to Get an Apostille for India (California Apostille Guide)

Updated: Apr 8

If you need to use a U.S. document in India—such as a birth certificate, marriage record, educational transcript, or power of attorney—you will need an apostille.

India is a member of the Hague Apostille Convention, which means no embassy legalization is required. Once your apostille is issued, your document is legally recognized throughout India.

As a California apostille facilitator, I help clients prepare, notarize (when required), and submit documents correctly to avoid delays or rejection.

Common documents include:

If India must accept it officially, the document will typically require an apostille.

How to Apostille Documents for India (California)

Step 1: Confirm the Correct Document Type

Most documents fall into two categories:

Vital Records

Must be certified copies issued by the appropriate authority (County Recorder or CDPH)

Notarized Documents

Must be signed in front of a California notary using proper acknowledgment or jurat wording

Step 2: Verify the Issuing State

California documents must be apostilled by the California Secretary of State.

If your document was issued in another state, it must be processed in that state.

Step 3: Submit for Apostille Processing

Once your document is prepared:

  • The Secretary of State verifies the signature and authority

  • An apostille certificate is attached

I review documents in advance, handle notarization if needed, and coordinate submission to ensure everything is correct the first time.

Step 4: Receive Your Apostilled Document

Once complete, your document is ready for use in India—no additional legalization is required.

Processing Time

Processing times depend on submission method:

  • In-person: fastest turnaround

  • Mail-in: can take longer depending on state workload

  • Facilitated service: faster and more reliable with document review included

Common Mistakes That Delay Apostilles for India

To avoid delays, review the most common apostille mistakes that cause rejections

Frequent issues include:

  • Outdated or incorrect vital records

  • Missing California notarial wording

  • Not notarizing documents that require it

  • Missing registrar certification for school documents

  • Removing staples (this voids the apostille)

  • Sending documents to the wrong state

  • Incorrect notarizations from non-specialized notaries

What Makes India Apostilles Unique?

India commonly requires:

  • Powers of attorney (especially for property and financial matters)

  • Educational documents

  • Birth and marriage certificates for OCI, visas, or legal filings

Because of this, accuracy is critical. Even small errors can result in delays or rejection.
