Certified Divorce Decree vs. Regular Copy
For a California apostille, a divorce decree must be a certified court copy issued by the California Superior Court where the case was filed. It has to carry the court's certification and the official's signature so the California Secretary of State can process it..
A regular photocopy, scanned PDF, downloaded court document, or uncertified copy cannot be submitted in place of the required certified court record.

Divorce Decree, Divorce Judgment, and Divorce Certificate
The terms divorce decree, divorce judgment, and divorce certificate are sometimes used interchangeably, but in California they do not always refer to the same document.
The main court record showing that a divorce was finalized is the Judgment of Dissolution, sometimes called the divorce judgment or divorce decree. It is issued by the Superior Court in the county where the case was filed, and a certified copy comes from that court.
California also has a separate document called a Certificate of Record, issued by the California Department of Public Health (CDPH). It is not the same as the court judgment. A Certificate of Record only lists the names of the parties, the county where the divorce was filed, and the court case number. It does not include the terms of the divorce and does not confirm that the divorce was final. CDPH issues it only for divorces that occurred between 1962 and June 1984; for all other cases, the record comes from the Superior Court.
Because of these differences, a receiving authority may request the complete certified judgment, specific certified pages, or another court-issued record. Before ordering a certified copy or requesting an apostille, confirm the exact document and pages the receiving authority requires. Can you apostille a divorce decree from another state?
No. A California apostille authenticates a California official's signature, so a divorce record from another state has to go through that state's apostille process. If your divorce was finalized outside California, send a copy for review and I can point you to the right path.
What if the destination country isn't part of the Hague Apostille Convention?
If the country isn't part of the Hague Apostille Convention, an apostille won't be accepted. The record will instead need authentication and embassy or consular legalization, which goes through additional offices and takes longer.
Is a CDPH Certificate of Record the same as a divorce decree?
No. A CDPH Certificate of Record only lists the parties' names, the county, and the case number, and it's issued only for divorces from 1962 to June 1984. For an apostille of the actual divorce record, you almost always need the certified judgment from the Superior Court.
